Terms of Use

Plain-English terms that govern your use of WebForger. Last updated 29 April 2026 (v1.1). Effective immediately for new accounts; existing accounts have 30 days to opt out by closing the account.

Quick read: WebForger is a website-building service operated by Always Digital Limited (NZ), trading as HornTech. By creating an account or using the service you agree to these Terms, our Acceptable Use Policy, and our Privacy Policy. 30-day unconditional money-back on any paid plan. Pay one full year of subscription fees and you own all AI-generated content — downloadable from your dashboard, free to take anywhere. New Zealand law applies and Auckland courts have jurisdiction. Nothing here removes statutory consumer rights you have under the NZ Consumer Guarantees Act or the Australian Consumer Law.

1. Who you are contracting with

The service is provided by Always Digital Limited, a New Zealand company trading as HornTech and operating the WebForger.ai platform ("WebForger", "we", "us", "our"). When these Terms refer to "you", they mean the person or organisation that opened the account. If you accept these Terms on behalf of a company, you confirm you have authority to bind that company.

2. The service

WebForger lets you create, host and manage websites built with our platform. The service includes AI-generated page drafts, hosted pages on Cloudflare infrastructure, lead-capture forms, blog and content tools, optional managed delivery by our team, and supporting dashboards. We may add, change or remove individual features over time. Where a change materially reduces a paid feature you rely on, we will give you at least 30 days' notice by email or in the dashboard.

3. Eligibility and account

You must be at least 18 years old, or the age of majority in your jurisdiction, to open an account. You are responsible for keeping your login credentials secure and for everything that happens under your account, including content posted, sites delivered and traffic served. Tell us at hello@webforger.ai immediately if you suspect unauthorised access.

4. Plans, pricing, GST and refunds

No auto-renewal. Paid plans are charged for a fixed period (monthly or annual). When the period ends, your account either pauses or returns to the Free tier; we will not silently re-bill you. You can renew at any time from the dashboard.

Prices and tax. Prices on the site are in NZD unless stated otherwise. New Zealand customers are charged NZ GST at the prevailing rate (currently 15%). Customers outside New Zealand are charged GST-exclusive: WebForger does not charge Australian GST or other foreign indirect taxes. You are responsible for any local tax, duty, or withholding that applies in your jurisdiction.

Payment methods. We accept payments via Stripe and PayPal. Refunds are returned to the original payment method, typically within 2 to 10 business days depending on your bank and card network.

30-day unconditional money-back. On any paid plan (monthly or annual), you may request a full refund for any reason within 30 days of the initial payment for that billing period. The refund is processed self-service (or by emailing hello@webforger.ai) and includes the subscription fee for that period. What is not refundable in any case: third-party pass-through costs (for example, domain registration fees, transaction fees retained by Stripe or PayPal where not recoverable), and human-time fees on the Custom / managed-delivery plan that have already been performed (managed delivery follows section 8 and any signed statement of work). After the 30-day window, the period you have already paid for is non-refundable, but you may close the account at any time to prevent future charges.

Effect of refund. Once a refund is issued, the related subscription period is reversed and any AI-generated content created during that period does not count toward the 12-month ownership threshold (see section 7). The site may be moved back to the Free tier or, on full account closure, taken offline (with the grace period in section 11).

Founding offers. If you are accepted into a founding offer (for example, the first 50 Pro accounts or first 5 Master partners), the discounted or free promotional period applies for the term stated on your invitation, on the plan you were accepted onto. After the promotional period ends we will give you at least 30 days' written notice before billing resumes at the then-standard published price; you may close the account in that notice window without further charge. We reserve the right to set the standard price after a promotional period and to change standard prices generally on 30 days' notice for renewals (existing prepaid periods are not affected). Promotional / Founding-offer months count toward the 12-month ownership threshold only when an actual subscription fee was paid.

Statutory rights. Statutory consumer guarantees that cannot be excluded by law continue to apply alongside this section.

5. Acceptable use

You must follow our Acceptable Use Policy. The AUP prohibits illegal, harmful and high-risk content (for example: child sexual abuse material, infringing material, malware, phishing kits, weapons sales, unlicensed gambling, hate speech, MLM/pyramid schemes). It also limits managed advertising services for certain regulated industries even where hosting is permitted. Violations can result in immediate suspension or termination without refund.

We rely on Cloudflare as our hosting and content-delivery provider. Your use of WebForger must also stay within Cloudflare's terms; if Cloudflare requires us to remove content, we will.

6. Customer Content (your uploads are always yours)

"Customer Content" means anything you upload, type, paste, or otherwise provide to the service: your logo, brand assets, photos you took or licensed, written copy you authored, files you uploaded, leads collected by your forms, and any data you import. Customer Content is yours, immediately and unconditionally. Nothing in these Terms transfers ownership of Customer Content to WebForger.

You grant WebForger a worldwide, royalty-free licence to host, store, copy, display, transmit, and process Customer Content for the purpose of providing the service to you and the people you direct (for example, your site visitors, your team). This licence ends when you delete the Customer Content or when your account is fully closed and the grace period in section 11 expires.

You confirm you have the rights to upload Customer Content and that it does not infringe anyone else's rights. We may remove Customer Content if we believe in good faith that it breaches these Terms, the AUP, or any law, or if we receive a valid takedown request (see Copyright & Takedown).

We do not use Customer Content to train third-party AI models without your permission. We may use aggregated, de-identified usage signals (such as feature engagement and error rates) to improve the platform.

7. AI-generated content (you earn full ownership)

"AI-Generated Content" means content the platform produces for you using automated systems and third-party AI models, including AI-written page copy, AI-written blog drafts, AI-generated images (such as FLUX-rendered visuals), and AI-generated source code or layout markup. AI-Generated Content does not include the platform's own code, shared templates, design system, fonts, or runtime infrastructure, which remain the property of WebForger and our licensors.

Default licence while you are subscribed. While your subscription is active, WebForger grants you an exclusive, perpetual, royalty-free licence to use the AI-Generated Content on your WebForger-hosted site at your registered domain (including the WebForger subdomain). Within this licence you may publish, modify, and serve the content from your site without further fee.

Ownership transfer (you keep everything once you have paid for a year). Copyright and all transferable rights in the AI-Generated Content automatically pass to you, with no further fee, when both of the following are true:

  • the 30-day refund window for the relevant billing period has expired; and
  • your account has paid the equivalent of twelve (12) months of subscription fees on a paid plan. Annual subscriptions count as twelve paid months on the day they clear the refund window. Monthly subscriptions count one month per paid month, accumulated over the lifetime of the account; gaps are allowed and previous paid months continue to count after a pause and resume. Refunded months do not count.

Once these conditions are met, the dashboard exposes a self-service download containing the AI-Generated Content (text, images, source markup, and a configuration snapshot). After transfer you may take that content anywhere, modify it, sell it, train AI on it, or use it on a competing platform. We will not charge you to transfer or download what you already own.

If you leave before transfer. If you cancel or downgrade before the transfer conditions are met, your existing licence to use the AI-Generated Content on your WebForger-hosted site continues for as long as the site remains hosted with us (including on the Free tier where applicable), but the AI-Generated Content is not yet yours to take elsewhere. Customer Content (section 6) is unaffected and exportable at any time.

Free tier. The Free tier provides a non-transferable licence to display AI-Generated Content on a WebForger subdomain only. The 12-month threshold begins counting from the first paid month after upgrade; Free months do not count.

Custom plan. Where AI-Generated Content is produced as a Custom-plan deliverable under a separate statement of work, ownership is governed by that statement of work and may transfer immediately on payment of the agreed fee.

Quality and review. AI-Generated Content is provided "as is" and may contain errors, omissions, or inaccuracies. You are responsible for reviewing and editing it before publishing, and for ensuring it complies with applicable law (including consumer-protection, advertising, and professional-licensing rules).

8. Managed delivery and professional services

Some plans include managed delivery: our team reviews drafts, edits content, and prepares your site for launch. Where we provide managed delivery, we act as a service provider performing tasks you direct; we do not become an agent for your business and we do not warrant the commercial outcome (for example, traffic or revenue results) of any site we deliver. Where we offer managed advertising services (for example, SEMForge under the Custom plan), additional terms apply, including industry restrictions imposed by the underlying ad platforms.

9. Domains, DNS and email

You can connect a custom domain you own, or have us route traffic via a WebForger subdomain. You are responsible for keeping your domain registration current and for the accuracy of the DNS records you authorise us to manage. We can stop routing a domain at any time if its use breaches these Terms or the AUP.

Lead-capture forms and notification emails sent on your behalf must comply with applicable anti-spam laws (including the NZ Unsolicited Electronic Messages Act and the AU Spam Act). We may rate-limit or disable email sending if we observe abusive or non-consensual sending patterns.

10. Beta features and changes

Features marked "beta", "preview" or "experimental" are provided without service-level commitments and may change or be removed without notice. Pricing for beta features may not reflect their final price.

11. Suspension, termination and data export

By you. You may close your account at any time from the dashboard or by emailing hello@webforger.ai. Closing the account stops future renewals; it does not retroactively refund prior periods (except under section 4). If your account has already met the AI-Generated Content transfer conditions (section 7), the self-service download remains available during the export grace period below.

Refund-triggered closure. If you exercise the 30-day money-back option in section 4, the related billing period is reversed. Your site is moved to the Free tier (subdomain only) or, if the account is closed, taken offline. Customer Content (section 6) remains exportable during the grace period. The refunded months do not count toward the section 7 ownership threshold.

By us. We may suspend or terminate your account, remove specific content, or disable features if: (a) you breach these Terms or the AUP; (b) we are required to by law or by Cloudflare; (c) your account presents a security, fraud or abuse risk; or (d) the account has been inactive on the Free tier for an extended period. For non-emergency breaches we will give you a reasonable opportunity to cure first.

Export grace period. After termination (by you or by us), we retain a reasonable archive of site files and account records for at least 90 days so you can self-service export Customer Content from the dashboard, or request an export by email. After the grace period, archived data may be permanently deleted. Some metadata (for example, billing records, abuse logs, anti-fraud signals) is retained longer where required by law.

12. Service availability and warranties

We aim for high availability through Cloudflare's network, but we do not guarantee that the service will be uninterrupted, error-free, or fit for any particular purpose beyond the description published on this site. Except as required by law, the service is provided "as is" and "as available", and we disclaim all warranties (implied or otherwise) to the maximum extent permitted.

13. Limitation of liability

To the maximum extent permitted by law, neither party is liable to the other for any indirect, special, incidental, consequential, or punitive loss, or for any loss of profits, revenue, goodwill, business opportunity, or data, even if advised of the possibility.

Our total aggregate liability under or in connection with these Terms in any 12-month period is capped at the greater of: (a) the amount you paid us for the service in that 12-month period, or (b) NZD 100. This cap does not apply to liability that cannot be limited by law (including death or personal injury caused by our negligence, fraud, or wilful misconduct), and does not affect statutory consumer guarantees.

14. Consumer guarantees (NZ & AU)

If you are using WebForger as a consumer (not in trade) you have rights under the New Zealand Consumer Guarantees Act 1993 and, where applicable, the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot be excluded by law. The limits in sections 12 and 13 apply only to the extent the law allows. If you are using WebForger in trade for business purposes (and the relevant statutes allow contracting out), the parties agree it is fair and reasonable to contract out of the consumer guarantees in sections 9 and 12-13 of the NZ Consumer Guarantees Act and the equivalent provisions of the Australian Consumer Law.

15. Indemnity

You agree to indemnify and hold WebForger and Always Digital Limited harmless from third-party claims arising from your Customer Content, your use of the service in breach of these Terms or the AUP, or your breach of any law applicable to your business (for example, professional licensing, advertising, consumer protection, or industry-specific rules).

16. Confidentiality and data protection

We treat the information you give us in confidence and only use it as set out in our Privacy Policy. We use sub-processors (for example, Cloudflare for hosting, model providers for AI generation, an email-sending provider, and analytics providers) listed at webforger.ai/subprocessors. We will give reasonable notice of material changes to that list.

17. Changes to these Terms

We may update these Terms occasionally. For changes that materially affect your rights or obligations, we will give you at least 30 days' notice by email or in the dashboard before they take effect; you may close your account in that notice window if you do not accept the changes. Minor changes (clarifications, contact details, broken links) take effect when we update the page.

18. Governing law and disputes

These Terms are governed by the laws of New Zealand. The District and High Courts of New Zealand at Auckland have non-exclusive jurisdiction over disputes. Before starting court proceedings the parties agree to make a good-faith effort to resolve the dispute, in writing, for at least 30 days. Nothing in this clause prevents either party from seeking urgent injunctive relief.

19. Miscellaneous

Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or successor on notice. Severability. If a clause is held unenforceable, the remainder of the Terms continues. No waiver. A failure to enforce a right is not a waiver. Force majeure. Neither party is liable for delays caused by events outside its reasonable control. Entire agreement. These Terms (together with the AUP, Privacy Policy and any plan-specific terms) form the entire agreement between us.
